In the present “Terms and Conditions”, the User (also known as you), will be able to find all the information related to the legal conditions (conditions of use and purchase) that define the relationship between the users and the responsible of this Web Site accessible at the URL address: https://goure.eu (hereinafter, the Web Site), that THE GOURMET REVOLUTION SL makes available to Internet users.

The use of the website implies full and unreserved acceptance of each and every one of the provisions included in these Terms and Conditions. Consequently, the user of the website must read these Terms and Conditions carefully each time he/she intends to use the website, as the text may be modified at the discretion of the owner of the website, or due to a change in legislation, jurisprudence or business practice.

THE GOURMET REVOLUTION SL has made free translations to this contract in different languages to facilitate its understanding but the only valid legal version is the one written in the Spanish language. Therefore, contracts with THE GOURMET REVOLUTION SL can be made in Spanish and are considered made in Spain.

  1. The Role of THE GOURMET REVOLUTION SL

THE GOURMET REVOLUTION SL is a rural solution that puts the focus on farmers and ranchers who do well by offering them a sales channel that allows them to sell their traditional product in a direct, easy and fair way to European end customers. A solution born in the village, by Antonio Triano and Pedro Borrego, sons and grandsons of farmers and ranchers from Huelva.

THE GOURMET REVOLUTION SL never buys food from producers at wholesale and then resells it at retail. Our value lies in:

  • Create and develop an online platform where family farmers and ranchers, which we affectionately call “Artisans”, can offer and sell their products directly to the end customer.
  • Implement and develop online marketing and dissemination tools to publicize the Artisans, their brand, business and products in new markets.
  • Customized package preparation and shipment management directly to end customers
  • Create, take care of and attend to the relationship between the Artisan and each customer who buys his food, pursuing loyalty.

Our income is in the form of commissions that come from the sale of these products through our web platform. This income from commissions will depend on the selling price that each Artisan wants to establish. On this price then add the services of THE GOURMET REVOLUTION SL and VAT depending on the country of destination. The percentage of commission for the services will never exceed 20% of the net selling price of the Artisan.

The Artisans that make up this Website (https://goure.eu) are traditional agricultural and livestock producers who, according to THE GOURMET REVOLUTION SL team, do it well. That is to say:

  • Artisans using sustainable and extensive farming techniques that help conserve, care for and protect our European environment and landscapes. 
  • Artisans who, through their traditional activities, keep the villages, their economy and their culture alive.
  • Artisans who respect the rhythms of nature and tradition where quality and ethics are always more important than quantity.

The products marketed on this Web Site, property of THE GOURMET REVOLUTION SL, are intended for end customers and for personal consumption by individuals and companies.

By entering into the contract, the customer acknowledges that he/she is of legal age and has sufficient legal capacity to be bound by these conditions of purchase.

GOURE® is a registered trademark owned by THE GOURMET REVOLUTION SL. In addition, the graphics, logos, page headers, button icons, scripts and service names contained or available on our web site are trademarks or trade dress of GOURE. Neither the trademarks or trade dress of GOURE may be used in connection with any product or service that does not belong to THE GOURMET REVOLUTION SL. All other trademarks not owned by THE GOURMET REVOLUTION SL that are included in or available through THE GOURMET REVOLUTION SL web site belong to their respective owners, who may or may not be affiliated or related in any way with THE GOURMET REVOLUTION SL.

The user knows and accepts that all the contents and/or any other elements of the website are property of THE GOURMET REVOLUTION SL, and agrees to respect the intellectual and industrial property rights owned by THE GOURMET REVOLUTION SL and/or third parties. If you do not provide us with all the information we need, we will not be able to fulfill your order.

Under no circumstances will data relating to the professional or economic situation or the privacy of other family members be collected from minors without their consent. If you are under thirteen years of age and have accessed this website without notifying your parents, you should not register as a user.

By placing an order through this Web Site, you represent that you are at least 18 years of age and have the legal capacity to enter into contracts.

This website respects and takes care of the personal data of its users. As a user you should know that your rights are guaranteed.

  1. SERVICE AVAILABILITY

Access to the website is free of charge for its users.

The items offered through this Web Site are only available for shipment to certain countries that you may select during the checkout process.

  1. HOW TO PLACE AN ORDER

To place an order, you must follow the online purchase procedure and make payment for the items you have selected. After this, you will receive an e-mail (“Order Confirmation”) acknowledging receipt of your order.

  1. PRODUCT AVAILABILITY

All products shown as “Available” (in stock) are ready to be shipped by each Artisan, however if for any error in the available stock the Artisan does not have the product purchased on goure.eu, we will call you to let you know, and you can choose another model available or request a refund of the amount paid. In case the Artisan could not fulfill his commitment, we will reimburse you any amount you may have paid.

The Artisans (agricultural and/or livestock producers) grow and elaborate products that vary according to the year and season, whose updated offer can be consulted on the GOURE Website (property of THE GOURMET REVOLUTION SL) and which may be modified at any time and without prior notice.

All the products that appear in this web are duly certified with guarantee seal, labels and traceability granted by health. And by the corresponding regulatory council in the case of PDO products.

  1. DELIVERY

Unless otherwise announced, THE GOURMET REVOLUTION SL will coordinate and arrange shipments to the address you indicate when placing your order.

Shipments to all European countries are free of charge. However, we reserve the right to include any type of charge or surcharge depending on the weight of the product, which will be visible at all times during the purchase process.

The delivery time for orders is between 1 and 5 working days from the date the customer’s order is shipped from our facilities.

Delivery service depends on the transportation company.

THE GOURMET REVOLUTION SL guarantees satisfaction with the quality of the product at all times.

The products offered through THE GOURMET REVOLUTION SL are not subjected to any artificial process or go through any intermediary or stored in cold storage other than that of their producers. 

For the purposes of these Conditions, “delivery” or the order shall be deemed to have occurred or the order to have been “delivered” at the time when you or a third party indicated by you acquires material possession of the products, which shall be evidenced by the signature of the receipt of the order at the agreed delivery address.

  1. FAILURE TO DELIVER

If we are unable to deliver your order, we will try to find a safe place to drop it off. If we are unable to find a safe place, your order will be returned to a carrier’s warehouse.

In order for you to receive your order without any inconvenience, we will send you an email when the order is picked up by the transport company and another email when the order is about to be delivered. If you are not going to be at the place of delivery at the agreed time, please contact the transport company to arrange delivery on another day. 

The order will be considered cancelled (without the right to a refund of the amount paid) if any of the following circumstances occur:

  • If the customer refuses acceptance without giving any reason.
  • If delivery is not possible after two attempts.

If after 15 days from the date your order is available for delivery, the order has not been delivered for reasons not attributable to us, we will understand that you wish to withdraw from the contract and we will consider it terminated. 

Please note that the transportation derived from the resolution may have an additional cost, so we will be authorized to charge you the corresponding costs.

  1. PRICES

In GOURE we have two sales modalities: sale of products associated with the adoption of a producer and sale of direct boxes composed of products from the same Artisan or several Artisans.

The price of each product and information about taxes and shipping costs will be mentioned on the website when purchasing the products.

The prices of all products include VAT and shipping costs.

Prices may change at any time, but (except as set out above) any such changes will not affect orders in respect of which we have already notified you of an Order Confirmation.

  1. ADOPTIONS

The adoption payment may be in the form of a single payment (one payment) or multiple payments (several payments). 

You have no commitment of permanence and may cancel the adoption or renewals at any time until the Artisan begins preparing your first order.

All adoptions will automatically renew unless you decide to cancel your adoption. Payment will be made using the payment method you have saved by default. The delivery address will be made to the address you have saved by default at the time of renewal or, failing that, to the address of the last shipment of that adoption. As for the amount reserved, in case it is modifiable, the amount that was selected the previous season will be respected.

The price of adoption or renewal may vary from season to season and you will be notified by email prior to collection. 

You may voluntarily cancel the adoption at any time up to the day before the producer starts preparing your order. 

If during the automatic renewal process there is any payment failure with your payment method, you will be informed by email so that you can correct it. After the renewal deadline, if the payment is still pending, you will lose the adoption and will not be able to recover it.

  1. DIRECT CASES

The payment of any type or format of direct boxes will be made in the form of a single payment (a single payment). There is no possibility of renewing the payment or commitment of any kind of permanence.

  1. PAYMENT METHODS

The price of the products will be charged the instant you click pay. To do so, you must provide GOURE with a valid credit or debit card (with the MasterCard or Visa symbol). You must inform us promptly with any changes to the card details, within the order deadlines specified on the website. You can make changes to your payment method by updating them in the My Account section or by emailing us at [email protected]. 

Our systems store your payment information hidden and tokenized for administrative purposes. We make every effort to ensure the security of your data. Your payment card details are fully encrypted, and are inaccessible to GOURE staff and any other third parties. We use the payment information provided at registration, once encrypted and tokenized, to enable automatic payment for regular orders.

By clicking “Pay” you are confirming that the credit card, bank account or any other method you have entered is yours or that you are the rightful owner of it.

Credit cards and bank accounts will be subject to checks and authorizations by the issuing bank, but if the issuing bank does not authorize payment, we will not be liable for any delay or non-delivery and will not be able to enter into any contract with you. We do not accept any responsibility for the time it may take for the relevant banks to process your payments.

We reserve the right to refuse delivery of orders and to cancel your account if you have stopped or suspended payments on the card you have provided to us. Through these Terms and Conditions you agree to compensate us in full for all reasonable costs and expenses (including legal costs) incurred in order to obtain payments not made in accordance with these terms and conditions.

  1.  PAYMENT METHODS

The following payment methods are accepted:

  • Credit and/or debit card: You can pay the products purchased with credit or debit card, through the secure payment platform Redsys with all the encryption and security systems of data transfer through the SSL protocol, so the buyer will enjoy at all times the protection of these channels. THE GOURMET REVOLUTION SL informs you that the Company does not have access to these bank cards and does not store your data. 
  • Bank transfer. You can make your payment by bank transfer to the CaixaBank account with IBAN ES202100721757520200200178984 and SWIFT: CAIXESBBXXX. Please indicate your name and surname or company name and order number in the reason for payment. Once the payment has been made, please send us a payment receipt by email to [email protected].
  1. SECURITY AND BUYER PROTECTION

The payments of the purchases in this Web Site https://goure.eu are made through Redsys with all the systems of encryption and security of data transfer through the SSL protocol, so the buyer will enjoy at all times the protection of these channels.

  1. BILLING

By default we will assume that you are a natural person. At the time of purchase a receipt will be issued on behalf of the Farmer with the detail of the amount of the order.

In case you are ordering on behalf of a company or legal entity, upon receipt of the order, you may request an invoice from the Farmer. Please contact us so that we can send you contact details and you can request the invoice directly from the Farmer. 

Note: CrowdFarming team has no control over the taxation of the Farmers who sell you the product. We are not responsible for them to issue their invoices in a timely manner.

  1. RETURN POLICY

All our products are shipped perfectly packed and protected so they should arrive in optimal conditions. In the event that you detect any problem with the packaging such as bumps or breakage upon receipt of the shipment, please note this circumstance in the acknowledgment of receipt of the transport agency. If these circumstances are not stated, the return will not be possible.

  1. RIGHT OF WITHDRAWAL

In accordance with the provisions of Article 102 and following of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users and other complementary laws, in the event that the order comprised perishable products, you may not request the withdrawal from the contract of sale or the refund of amounts paid. You are also informed that the right of withdrawal cannot be exercised after delivery of certain products that cannot be returned for reasons of hygiene or health protection.

With respect to other products, you have a period of 14 (fourteen) days from the date of receipt of the products or gift cards ordered to withdraw without having to justify yourself or pay penalties, except for possible return costs, which are at your expense.

To exercise the right of withdrawal, you must notify THE GOURMET REVOLUTION SL of your decision to withdraw from the contract by sending an email to [email protected].

We will inform you without delay on a durable medium (e.g. by e-mail) of the receipt of such withdrawal. In order to comply with the withdrawal period, it is sufficient that the communication concerning your exercise of the right of withdrawal is sent before the withdrawal period expires.

Until receipt of the product by the seller, you remain the owner of the returned product. We reserve the right, at our discretion, to refund the price of the product without requiring its return. In such a case, title to the product for which the price has been refunded shall not pass to the seller.

  1. CONSEQUENCES OF WITHDRAWAL

In the event of withdrawal by you, we will refund all payments received from you, without undue delay and in any event not later than 14 days from the date on which we are informed of your decision to withdraw from this contract. 

We will proceed to make such reimbursement using the same means of payment used by you for the initial transaction. We may withhold reimbursement until we have received the goods. You must return or hand over the goods to us without undue delay and in any event not later than 14 days from the date on which you communicate your decision to withdraw from the contract to us. The deadline shall be deemed to have been met if you return the goods before the 14-day period has expired. 

The products will be delivered with the seals and packaging intact in their original packaging. You shall bear the direct cost of returning the goods. You will only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

In the case of orders containing perishable and non-perishable products, the withdrawal clause for each type of product shall apply in the proportion that the order contains each product.

  1. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The network of artisans that make up THE GOURMET REVOLUTION SL elaborate in detail natural, traditional and quality products. That is why the agricultural and livestock products offered in this Web Site property of THE GOURMET REVOLUTION SL are unique, being able to vary their organoleptic qualities such as color, smell, taste and appearance. None of these qualities can be a reason for any refund.

The exceptions in which the right of withdrawal does not apply are:

  • Products that once started, the difference in weight is more than 10% of the total initial weight.
  • Products that cannot be returned for reasons of hygiene or health protection if they have been unsealed by you after delivery (e.g. oil).
  • Personalized products with a name of your choice unless the product was damaged or defective upon receipt.
  • Products that may deteriorate or expire quickly (e.g., perishable foods or products with an expiration date of less than one year).

In the event that any of our products meets any of the above mentioned assumptions, THE GOURMET REVOLUTION SL will contact you to find a solution that satisfies both parties (e.g. sending a new product or granting a discount for the value of the product).

  1. PRODUCT QUALITY GUARANTEES

All products on this Web Site indicate the best-before date and the necessary conditions for their proper preservation, so we recommend that you observe these recommendations.

All the products have undergone a careful quality control, and are marketed according to the standards approved by the brand of each of the Artisans. Personal opinions about the salt or curing point, as well as aesthetic considerations of the pieces will not be considered defects of the product.

If you consider that a traditional product is not in a suitable condition for consumption, you should contact Customer Service as soon as possible at: www.goure.es, www.goure.eu, www.goure.fr or www.goure.de by e-mail to [email protected] to communicate the nature of the problem, the time and conditions of its occurrence.

In the event of a claim, the return of the Product may be made in accordance with the provisions of Item 14. Return Policy of these Terms and Conditions. 

  1. VISIT TO THE ARTISANS

Artisans spend most of their time taking care of their crops and livestock, and making traditional products so they hardly have time to coordinate and make visits to their customers. That is why THE GOURMET REVOLUTION SL is in charge of scheduling and coordinating the visits. 

We recommend that you do not come to the Artisan’s premises without first obtaining written confirmation from THE GOURMET REVOLUTION SL.

You will be able to visit the Artisan’s farm that you have adopted as long as:

  • You inform THE GOURMET REVOLUTION SL by mail to the address [email protected] and the request has been accepted by us generating an appointment.
  • Its adoption remains active and in force.

THE GOURMET REVOLUTION SL does not participate in the service of visits nor has any responsibility on it. THE GOURMET REVOLUTION SL only intercedes as a mediator to arrange the visits according to the dates that the Artisan marks as available. However, we cannot assure you that the Artisan will be available on these dates.

  1. DATA PROTECTION

THE GOURMET REVOLUTION SL has adopted the provisions of the Personal Data Protection Law, in accordance with the current Organic Law 15/1999, of December 13, 1999, on Personal Data Protection, and has implemented all the necessary technical and organizational measures to guarantee the security of the personal data of its customers and users and to avoid its alteration, loss, treatment or unauthorized access. The security level chosen corresponds to the nature of the personal data provided. The personal data that may be collected through this website will be treated fairly and lawfully, in accordance with the principles established by Law 15/1999, of December 13, Protection of Personal Data (LOPD) and other implementing regulations.

These data may be incorporated into files duly registered with the Spanish Data Protection Agency, which are under the responsibility of THE GOURMET REVOLUTION SL, in order to sell you the products in which you are interested, communicate with you, respond to your requests and send you communications that may be of interest to you and always in relation to the services of THE GOURMET REVOLUTION SL (including advertising and newsletters).

Your data may not be disclosed to third parties without your consent, except in the case of the exceptions provided for in Articles 11.2 and 12 of the aforementioned law with constitutional rank 15/1999.

  1.  CONSUMER WARRANTY

You warrant to THE GOURMET REVOLUTION SL that you will not be subject to complaints, claims, actions and/or claims as a result of the violation of any of your obligations mentioned in these conditions. 

You agree to compensate THE GOURMET REVOLUTION SL for any damages you may suffer and to pay any expenses and/or charges you may incur as a result.

  1. EXCLUSION OF LIABILITY

THE GOURMET REVOLUTION SL is not responsible for the damages produced in the software and computer equipment of You or third parties during the use of the services offered in this Web Site, as well as for the damages of any kind produced in You that are caused by failures or disconnections in the telecommunications networks that produce the suspension, cancellation or interruption of the service of the Web Site during the provision of the same one or with previous character.

Our liability in connection with any product purchased on our Web Site shall be strictly limited to the purchase price of such product.

Both the access to the web and the non-consented use that can be made of the information contained therein is the sole responsibility of the user. THE GOURMET REVOLUTION SL will not be responsible for any consequence or damage that may arise from such access or use. THE GOURMET REVOLUTION SL makes these terms and conditions available to you in advance, in accordance with current legislation, so that they can be consulted, stored and reproduced.

In the event that any provision of these Conditions is declared null and void or unenforceable, in whole or in part, by any Court, Tribunal or competent administrative body, such nullity or unenforceability shall not affect the remaining provisions. In that case, the clause or clauses affected shall be replaced by another or others that have the most similar effects to those of the replaced clauses.

  1. APPLICABLE TIMETABLE

In this Web Site, all deadlines and references to working days shall be understood to be made with reference to the Spanish National Labor Calendar.

  1. FULL AGREEMENT

You will be informed of these modifications by any useful means. If you do not accept the modified terms and conditions, we recommend that you do not use our Web site.

Any of you who use the Services after the entry into force of the modified general terms and conditions are deemed to have accepted these modifications.

  1. APPLICABLE LAW AND COMPETENT JURISDICTION

These General Conditions are governed by Spanish law.

If you are contracting as a consumer, for the resolution of possible disputes, the parties agree to submit, at their option, and waiving any other jurisdiction that may correspond to them, to the courts and tribunals of the city corresponding to the domicile of the Partner or User. 

If you are contracting as a company, the parties agree to submit to the Courts and Tribunals of Salamanca, expressly waiving their own jurisdiction if they have one.
